USPS Settles Suit For $1,760,000.00

Carla Bridget Cox-McCoy, 33, was driving her pickup truck eastbound on I-64 in eastern Henrico County about 10:55 p.m. on Aug. 3 when the driver of a westbound USPS tractor-trailer crossed the median and sideswiped the pickup.

McCoy, who lived in the 1200 block of Admiral Gravely Boulevard, died about two hours later.

The family’s attorney, Stephen M. Smith of The Brain Injury Law Center, alleged that the driver of the tractor-trailer had fallen asleep.

Smith today said he was prepared to file suit in federal court but reached the settlement with the postal service before that was necessary.

The settlement includes annuities that provide compensation for McCoy’s husband, Thornton McCoy Sr., and money for the education of her four children and a foster child. The total payment from the settlement will be $2.4 million, Smith said.
