Cyclist Struck by Passing Truck’s Side Mirror Awarded $2,400,000.00 for Mild Head Injury
John Doe, 60, was severely injured June 22, 2001, as he rode his bicycle along Shore Drive in Virginia Beach. According to the lawsuit filed in the Circuit Court of Virginia Beach, Chad Swygert, driving a commercial, box-type delivery truck, was traveling in the same direction as Doe, about 50 mph, and passed Doe, who was in the right lane.
The truck’s side mirror struck Doe and knocked him to the ground, where he apparently lost consciousness, said one of Doe’s attorneys, Stephen M. Smith, of The Brain Injury Law Center.
Doe suffered a traumatic brain injury as evidenced by several symptoms, including headache, neck pain and changes in his cognitive functioning abilities, Smith said. In addition, the retired chiropractic physician was left unable to find or regain meaningful employment.
“These are classic symptoms of a mild brain injury,” added Smith.
The lawsuit was filed against Swygert and his employer, Eastern Aluminum Supply of Virginia. The settlement was reached through mediation on Sept. 11.
